Family liability insurance in Spain

The responsabilidad civil inside a Spanish home policy is written for an ordinary household. A family with staff, a pool, guests, dogs, a boat, children studying abroad and homes in more than one country needs limits in the millions, worldwide, with defence costs paid on top — and a wording that says so before anything happens.

What family liability covers in Spain

Spanish home policies usually carry two liability sections that are easy to confuse. Liability as owner (responsabilidad civil inmobiliaria) answers for the property itself: a roof tile that falls on a passer-by, water escaping into the flat below, a tree that comes down on a neighbour’s car. Family or private liability (responsabilidad civil familiar or privada) answers for the household in daily life, wherever it happens: a child who injures another on the ski slope, a bicycle accident, a guest hurt at a dinner you host.

Both are frequently included in a standard hogar policy. What varies is the limit, the territory and who counts as insured — and for a household with significant assets, those three details decide whether the section is worth anything when a serious claim arrives.

General guidance only, for international clients considering or arranging insurance in Spain. What a policy covers, its limits and its exclusions are set by the insurer and by the wording of that specific policy — not by this page. Nothing here is legal advice.

The standard we place for high-value households

These are the reference conditions of the high-net-worth wordings we place in Spain, where the family liability section sits inside a private-client household policy or alongside it:

  • Limits that match the householdFamily liability of €7.5 million or more, depending on the insurer.
  • Defence costsLegal defence costs are covered; with Chubb, they are paid in addition to the limit.
  • Who is coveredThe household, including children studying away, and anyone looking after your pets occasionally; guests and domestic staff in connection with the residence.
  • Every residenceAs owner, tenant or occupier — in Spain, in Portugal, or wherever the family has a home.

These are the reference conditions of the high-net-worth wordings we place. Cover, limits, excesses and exclusions vary by insurer and by risk, and are confirmed only in the policy documentation issued to you.

Where Spanish households generate liability claims

Pools, terraces and guests

A villa with a pool, steps and terraces entertains people who do not know the property. Injury to a guest, a neighbour’s child or a contractor is the classic serious claim. In a comunidad de propietarios, the shared pool is the community’s policy; your private terrace is yours.

Water and the flat below

In apartments, water escaping into a neighbour’s home is one of the most frequent liability claims in Spain. Check whether it falls under the owner section, the family section or the community policy — and that it is not left between them.

Household staff

Domestic employees (empleados de hogar) must be registered with Social Security by the employer. Registration gives them public cover for accidents at work; it does not remove your own civil liability if negligence is alleged, or for damage staff cause to others while working for you.

Dogs and horses

Dogs of breeds classed as potentially dangerous need a municipal licence and compulsory liability insurance, and the 2023 animal welfare law provides for liability insurance for dog owners more generally, subject to implementing rules and regional requirements. Horses are often excluded from standard family sections and need to be named.

Boats, jet skis and fincas

Motorised recreational craft, jet skis and larger sailing boats in Spain carry their own compulsory third-party insurance, and most family sections exclude motorised watercraft above a small size, so the boat usually needs marine liability. On a finca, hunting requires the hunter’s own compulsory liability cover.

Letting the property

A family liability section almost always excludes business activity, and letting — long term or to holiday guests — is treated as one. Several regional tourist-letting regimes also require the owner to hold liability cover. See landlord insurance in Spain.

Choosing the limit and the territory

The limit is not a formality. It should reflect what a claimant could realistically pursue — the household’s assets, in every country where they are held — and the courts that could hear a claim. Three questions shape the recommendation:

  1. Where the family lives and travels. A worldwide section follows the household, but many wordings restrict claims brought in the United States or Canada. For families who spend time or hold assets there, this is checked first.
  2. What already exists. An American umbrella policy, a liability section in a Portuguese home policy or a UK household policy: the Spanish cover should sit alongside them, with no duplicated premium and no gap between them.
  3. How defence costs are treated. Defence costs paid on top of the limit leave the full limit for the claim itself; costs inside the limit erode it exactly when a long dispute makes them largest.

What stays separate

Family liability covers the household in private life. Some exposures are insured elsewhere, and the review makes the boundary explicit rather than assuming it:

  • Motor vehicles. Liability for driving is the compulsory motor policy — see car insurance in Spain.
  • Professional activity. Advice, services or a business you run need professional indemnity, placed on their own terms.
  • Boards and family offices. A directorship, a foundation or a family office is directors and officers cover, not household liability.
  • Letting. Rental income turns the property into a business risk for the insurer — landlord cover, declared on the correct basis.

How we work

One adviser, from the first review to the renewal and, if it comes to it, the claim. We read the liability sections you already hold, in Spain and elsewhere, set out in writing where the limit, the territory or the definition of who is insured falls short, and recommend how to close the gap — inside a private-client household policy or as a stand-alone section. For the household as a whole — homes, collections and family protection — see private clients in Spain.

Frequently asked questions

Does my Spanish home policy not already include liability?

Usually it does: most Spanish home (hogar) policies carry responsabilidad civil, often in two parts — liability as owner of the property and liability as a private family in daily life. The questions are the limit, which is frequently set for an ordinary household, where the cover applies, and who counts as insured. For a household with staff, a pool, guests, children abroad or several homes, those three answers decide whether the section is adequate.

What limit should a household like ours carry?

There is no single right figure, but for high-net-worth households we typically look at limits of several million euros, worldwide, with legal defence costs paid on top of the limit rather than eroded from it. The right limit depends on where the family lives and travels, on the assets a claimant could pursue and on the courts that could hear a claim — which is why we set it out in writing with the reasoning.

Are our household staff covered?

Domestic employees in Spain must be registered with Social Security by the employer, and that registration gives them public cover for accidents at work. It does not remove the employer’s own civil liability if negligence is alleged. A good family liability wording extends to claims by domestic staff and to injury or damage staff cause to others while working for you; we check both.

Do I need liability insurance for my dog in Spain?

For dogs of breeds classed as potentially dangerous, yes: the owner needs a municipal licence and compulsory liability insurance. Spain’s 2023 animal welfare law also introduced a liability insurance obligation for dog owners more generally, and how it applies has depended on implementing rules, so we confirm the current position and make sure your policy names the animal where it needs to.

Does the cover follow us outside Spain, including the United States?

A worldwide family liability section follows the household wherever it is, but many wordings restrict claims brought in the United States or Canada. For families who spend time there or hold assets there, that restriction is one of the first things we check, and where an American umbrella policy already exists we align the two rather than duplicate them.

Can one policy cover our homes in Spain and Portugal?

Often, where the insurer writes both countries: the family liability section then applies to every residence the household owns or occupies, as owner, tenant or occupier. Where it is not possible, the Spanish and Portuguese policies are aligned so that no gap opens between them and the limits are consistent.

Is professional or board liability included?

No. Family liability covers the household in private life. Your professional activity, a company you run, a board seat or a family office are insured separately, under professional indemnity or directors and officers cover, and a letting business needs landlord cover. We review those alongside the family section so the boundary between them is explicit.

Also in Portugal

Households with a home in Portugal as well are handled by the same adviser, to the same standard — and, where the insurer writes both countries, under one family liability section.
